Terms and Conditions

Welcome to Peyala. These Terms and Conditions ("Terms") govern your use of the Peyala mobile application ("App") and related services provided by Peyala Ltd ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Peyala App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App. We reserve the right to terminate accounts that do not meet this requirement.

3. Account Registration

- You may register using your phone number (OTP verification), email and password, Google Sign-In, or Apple Sign-In.

- You are responsible for maintaining the confidentiality of your account credentials.

- You agree to provide accurate, current, and complete information during registration.

- You are responsible for all activities that occur under your account.

- You must notify us immediately of any unauthorized use of your account.

4. Services

Peyala provides a platform that allows users to:

- Browse menus from participating cafes and restaurants

- Place orders for pickup or dine-in

- Make payments through supported payment methods

- Save favourite items and locations

- Receive promotions and offers

We act as an intermediary between you and the participating merchants. We are not responsible for the preparation, quality, or safety of food items, which remain the responsibility of the respective merchants.

5. Orders and Payments

5.1 Placing Orders

- All orders are subject to availability and acceptance by the merchant.

- Prices displayed are set by the merchants and may change without prior notice.

- Once an order is confirmed, it constitutes a binding agreement between you and the merchant.

5.2 Payment Methods

We support the following payment methods depending on your location:

Bangladesh: bKash, EBL Card Payment, Peyala Cash

Singapore: Adyen, CyberSource

5.3 Peyala Cash

- Peyala Cash is a prepaid credit balance within the App.

- Peyala Cash is non-transferable and cannot be exchanged for real currency.

- We reserve the right to modify Peyala Cash terms at any time.

5.4 Pricing

- All prices include applicable taxes unless stated otherwise.

- Promotional discounts and promo codes are subject to their specific terms and expiry dates.

6. Cancellations and Refunds

- You may cancel an order before it is accepted by the merchant.

- Once a merchant has accepted and begun preparing your order, cancellation may not be possible.

- Refunds, if applicable, will be processed to your original payment method or as Peyala Cash credit, at our discretion.

- Refund processing times vary depending on the payment method used.

7. User Conduct

You agree not to:

- Use the App for any unlawful purpose

- Provide false or misleading information

- Interfere with or disrupt the App's functionality

- Attempt to gain unauthorized access to our systems

- Use automated systems or bots to access the App

- Harass, abuse, or harm merchants, other users, or our staff

- Exploit promotions, promo codes, or offers in a fraudulent manner

8. Intellectual Property

- The App, its content, features, and functionality are owned by Peyala Ltd and are protected by copyright, trademark, and other intellectual property laws.

- You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

- You may not copy, modify, distribute, or reverse-engineer any part of the App.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to

our data practices as described in the Privacy Policy.

10. Notifications

- We may send you push notifications regarding order updates, promotions, and account activity.

- You can manage notification preferences through your device settings.

11. Third-Party Services

The App integrates with third-party services (payment gateways, map services, social login providers). Your use of these services is subject to their respective terms and

conditions. We are not liable for any issues arising from third-party services.

12. Limitation of Liability

To the maximum extent permitted by law:

- Peyala Ltd shall not be liable for any indirect, incidental, special, or consequential damages.

- We do not guarantee uninterrupted or error-free access to the App.

- We are not responsible for the quality, safety, or legality of food items provided by merchants.

- Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

13. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, accuracy, or fitness for a

particular purpose.

14. Account Termination

- You may delete your account at any time through the App settings.

- We reserve the right to suspend or terminate your account if you violate these Terms.

- Upon termination, any remaining Peyala Cash balance may be forfeited.

15. Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes

constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes shall be subject to the exclusive

jurisdiction of the courts in Dhaka, Bangladesh.
